Notice of the General Office of the Ministry of Agriculture and Rural Affairs on Strengthening the current supervision and administration of pesticides

To implement the "Regulations on Pesticide Management" and the spirit of the National Production Safety teleconference, local agricultural and rural departments should earnestly strengthen the supervision and management of pesticides, coordinate the development and safety of pesticides, maintain the normal production and operation order of pesticides, effectively prevent pesticide safety risks, and ensure the needs of agricultural production drugs. The relevant work requirements are hereby notified as follows.
First, strengthen the implementation of pesticide administrative approval duties
According to the relevant regulations and the "three fixed" responsibilities of the agricultural and rural departments, all localities should seriously do a good job of the provincial preliminary examination of pesticide registration, production license, business license and other administrative approval work. In the preliminary examination of pesticide registration, it is necessary to focus on reviewing the authenticity, integrity, standardization and effectiveness of registration application data, so as to avoid problems such as unsealed test samples, incomplete registration application data, non-conforming data, and untrue test data. In terms of pesticide production licensing, it is necessary to implement industrial policies and safety and environmental protection management requirements, combined with the national "Industrial Structure Adjustment Guidance Directory" and the "Fourteenth Five-Year National Pesticide Industry Development Plan", strictly control the number of pesticide production enterprises, regulate the relocation and transfer of enterprises across regions, guide enterprises to become bigger and stronger, and promote the high-quality development of the pesticide industry. We must strictly control the approval of excess production capacity, phase out backward production capacity, properly deal with zombie enterprises, and investigate and punish enterprises that produce and sell counterfeit goods in accordance with the law. Optimize the layout of the pesticide industry, and promote new enterprises and new production capacity to enter the corresponding chemical parks in accordance with the law. Enterprises due to relocation, production process upgrading, etc., resulting in the production license can not be extended as scheduled, but it is necessary to apply for the continuation of pesticide registration, the local provincial agricultural and rural departments need to submit an official document to the Ministry of Agriculture and Rural Affairs to the production license of the enterprise, clear the scope of production under construction, time schedule and proposed suspension period. In terms of pesticide business licensing, it is necessary to strictly compare the licensing conditions, combined with the market supervision in the past five years, and eliminate a number of business units that do not meet the licensing conditions and sell fake and inferior pesticides in accordance with the law.
Second, strengthen pesticide market supervision and management
In response to the current illegal production and illegal operation of pesticides in some places, local agricultural and rural departments should strengthen the supervision and inspection of pesticide production enterprises, business units, and e-commerce operators, focusing on checking whether the production and operation license is complete, whether the quality of pesticide products is qualified, whether the pesticide packaging labels meet the requirements, and whether the purchase and sales ledger records are complete. Whether the e-commerce operators have the business license, whether the illegal sale of prohibited pesticides and unregistered pesticides, especially to crack down on illegal behaviors such as borrowing, licensing, and OEM production and sales in the name of commissioned processing, and bundling sales in the form of package packaging. It is necessary to strengthen daily supervision, find out and grasp illegal clues, strengthen the connection of execution, and cooperate with public security departments to investigate and handle major cases according to law. All localities should arrange special funds to increase the quality supervision and random inspection of pesticide products. Cowpea main producing areas should highlight the special supervision and sampling of pesticide product quality, fully implement the purchase and sales ledger records, record the application of restricted pesticides, guide farmers to use scientifically and rationally, and resolutely crack down on illegal sales and use of prohibited pesticides, hidden addition and production and sale of fake and inferior pesticides. Local agricultural and rural departments should smooth the hotline for pesticide reporting, and promptly investigate and handle the clues of reporting cases.

Third, strengthen the supervision and inspection of pesticide registration test units
The results of pesticide registration test are related to the fairness and quality safety of pesticide registration. Since the beginning of this year, the Ministry of Agriculture and Rural Affairs has publicly notified four pesticide registration test violation units, suspended the qualification of test units, and put forward rectification requirements. Local agricultural and rural departments should strengthen the supervision and inspection of territorial test units, in view of the frequent changes in key positions, the quality management system is not standardized, the test data is not true and other problems, carry out "four not two straight" flight inspection, the annual inspection proportion is not less than 30%, and timely submit the supervision and inspection results to the Ministry of Agriculture and Rural Affairs. The Ministry of Agriculture and Rural Affairs will organize the flight inspection of pesticide registration test units in a timely manner, and those with serious problems in test units, territorial supervision or "local protection" will be dealt with according to law and publicly notified.
Fourth, strengthen pesticide industry guidance and services
The Ministry of Agriculture and Rural Affairs is organizing the revision of five supporting regulations and series of normative documents such as pesticide registration and production license, and the agricultural and rural departments around the country should actively feedback their suggestions and do a good job of publicity and interpretation work in advance. To strengthen planning guidance, the "14th Five-Year" national pesticide industry Development Plan has been carried out a mid-term evaluation, and all localities should refine the implementation plan of the province against the planning objectives, tasks and requirements, rationally plan the industrial layout, guide enterprises to become bigger and stronger, and promote the implementation of the plan in the jurisdiction. To strengthen the production and marketing information dispatch, all localities should specify special personnel to regularly dispatch the production and marketing information of pesticides, according to the disease and pest control needs of grain and important agricultural products, guide the production and supply of pesticides, and avoid blind production, out of stock, and price fluctuations. At the same time, it is necessary to strengthen the training and guidance of pesticide production and operation enterprises and grassroots pesticide supervision personnel, timely understand the difficulties existing in production and operation enterprises, and do a good job in relevant policy interpretation, information consultation and technical guidance services.
Fifth, strengthen pesticide safety risk prevention
The Mid-Autumn Festival and National Day are approaching, and all localities should strengthen pesticide safety risk prevention in accordance with the principle of production safety supervision "management industry must be in charge of safety, management business must be in charge of safety, management production and operation must be in charge of safety". In the production process, it is necessary to combine the approval of production licenses and on-site supervision and inspection, check the implementation of production safety measures in enterprises, and guide and urge enterprises to implement the main responsibility of production safety. In the operation process, strict implementation of restrictions on the use of pesticides fixed-point management, real-name purchase. Fully implement the management of pesticide purchase and sale ledger and traceability, and urge operators to carefully verify the legality of the source of purchased pesticides. In the use process, it is necessary to strengthen the training and guidance on the scientific and safe use of pesticides, urge users to use pesticides in accordance with the requirements of the pesticide label, strictly observe the safety interval, and prevent the use of pesticides beyond the range, over dose, and over frequency. It is necessary to strengthen the monitoring of pesticide safety risks, and prevent the occurrence of drug safety accidents such as human and livestock poisoning, crop damage, and environmental pollution. It is necessary to seriously investigate and punish the illegal use of highly toxic pesticides on vegetables, fruits, tea and other crops, and strictly crack down on the sale and use of paraquat and other export-only pesticides in China to ensure agricultural production safety and agricultural product quality safety.
Pesticide supervision and management is one of the important assessment contents of national quality work and food safety work, and local agricultural and rural departments should attach great importance to it and effectively implement the responsibilities of pesticide supervision and management. In order to facilitate the work arrangement and information exchange, please fill in the provincial pesticide supervision and management responsibility division form and seal it (see annex) before October 8, and submit it to the Department of Plant Management of the Ministry of Agriculture and Rural Affairs (Department of Pesticide Management); Submit the annual summary report of pesticide supervision and management before December 20.
